Situation

Rose Bowlus Law is a boutique corporate and startup law firm serving SMB clients across California. As AI tools became accepted and adopted in 2026, law firms faced a challenge unlike any other industry: the legal profession operates under strict ethics rules — ABA Model Rules, California Bar guidance, CCPA, and federal agency AI obligations — that govern exactly what AI can and cannot do with client data, data retention, and client-attorney privileges. Adopting AI carelessly could result in disciplinary action or bar sanctions. Doing nothing meant falling behind competitors who were more efficient. The firm needed a CTO who could navigate both the technical opportunity and the regulatory minefield simultaneously.

Task

Serve as Fractional CTO and AI Strategic Advisor — define the firm's technology roadmap, create an AI software requirements checklist, evaluate legal SaaS platforms for CCPA compliance and product function fit, and on-board new platforms that have passed the firm's technical due diligence.

Action

  • Created AI software vendor requirements accounting for the ruling in Heppner vs. United States on client-attorney privileges and the three elements that matter for the Kovel Doctrine workaround to hold.
  • The AI software vendor requirements dovetailed into the collaboratively developed AI Use Policy, AI Governance Ethics Guide, and the corporate AI Strategy.
  • The AI Governance & Ethics Compliance guide covered ABA Model Rules, California Bar guidance, CCPA, and federal agency AI obligations — giving the firm a clear policy for which AI tools could be used, how, and with what safeguards in place.
  • Evaluated and onboarded an AI document review and redlining tool, and AI video conference notetaker software.

Result

The firm now operates with a complete formal AI framework across all AI activities — governance and compliance, AI use policy, and AI vendor software requirements — all compliant with ABA Model Rules and California Bar guidance. On-boarding new software vendor tools and user activities are now assured compliance while also achieving improved productivity.
